Learn all the legal aspects of Medical Cannabis in India

The moment we talk about Medical Cannabis in India, the first question that is thrown at us is if it is backed by law in the country. Well, yes, it very much is, but it comes with a list of complicated rules and regulations that often confuse the masses. Interestingly, until 1985, Marijuana was legal in India. But then, due to the western influence driven by Ronald Reagan's war on drugs, many countries, including India, created laws to regulate and restrict activities related to Cannabis or Marijuana. Subsequently, the Narcotic Drugs and Psychotropic Substances (NDPS) Act came into action in 1985. It looks after the production, sale, and consumption of Cannabis, amongst other drugs in India. Based on the content of this Act, every Indian state has further laid down its individual rules on the transactions related to Cannabis.

Now, to understand more about Medical Cannabis, it is first imperative for us to know how the NDPS Act defines Cannabis. As per the Act, Cannabis means

a) Charas (unrefined or purified) is a separated resin obtained from the cannabis plant. It includes concentrated preparation or resin called liquid or hashish oil.

b) Ganja, the flowering or fruiting top that excludes seeds and leaves which does not belong to the top part.

c) Any dry mixture or drink made out of charas or ganja.

In easier words, Cannabis is the flowering or fruiting top of the Cannabis plant, from which the resin (a solid or highly viscous substance of plant or synthetic origin that is typically convertible into polymers) has not been extracted.

Now, these flowers and resin of the cannabis plant, are banned by the NDPS Act. On the other hand, the hemp plants or the leaves and seeds of the cannabis plant are exempted. This is where the catch is. The elements of Cannabis that contain all the therapeutic properties are present in these leaves and seeds itself. They include cannabinoids such as CBD and THC, that help in fighting various illnesses. And as per the NDPS Act, the use of these for medical and scientific purposes is legal.

So, the Ministry of Ayurveda, Yoga & Naturopathy, Unani, Siddha, and Homoeopathy (AYUSH) also backs Medical Cannabis, adding more support to its legal backing.
